EASTON, Mass. (AP) - A Massachusetts man was on medication and had YouTube open on his phone while driving at the time of a crash that killed another driver, court documents show.
Easton police officers found Jake McCabe’s phone unlocked with a video playing on it while investigating the fatal crash that took place Sunday, The Enterprise reported Thursday.
McCabe, 25, was arrested Tuesday night and charged with manslaughter in connection with the head-on collision that killed Scott Lewis, 37.
A police report also states that McCabe told police he was using Xanax and another prescribed psychiatric medication at the time of the crash.
Investigators are reviewing surveillance camera footage near the scene of the collision where several witnesses told officials they saw McCabe’s car speeding in the moments before his car collided with the victim’s vehicle.
McCabe’s lawyer, Kevin Nugent, said the McCabe family is “devastated by this tragic event,” but “remain certain” that the investigation will reveal that he did not operate his motor vehicle negligently.
McCabe is set to be arraigned at Taunton District Court on June 2, court officials said.
He posted $10,000 bail and was released Tuesday, according to the Bristol County district attorney’s office.
