MONTGOMERY, N.Y. (AP) - A grand jury in Orange County has declined to indict officers for the 2019 shooting where a state trooper shot and killed Luke Patterson, New York State Attorney General Letitia James said in a statement.
The grand jury reached a decision Tuesday and that James wrote in a statement that prosecutors will respect the ruling, the Times Herald-Record reported.
On May 23, 2019, state troopers responded to a report of a stranded vehicle on I-84.
Troopers arrived on the scene and moved a vehicle that was blocking westbound traffic on I-84.
Troopers then found Patterson walking on the shoulder of I-84, he did not respond to them or comply with commands.
He was shot when he suddenly attempted to enter the police car, authorities said.
Patterson was unarmed.
The Attorney General investigated the shooting following a 2015 executive order by Gov. Andrew Cuomo, a Democrat, directing the office to review cases in which unarmed people are killed by police.
