CHARLESTON, W.Va. (AP) - The director of West Virginia’s Division of Natural Resources is no longer charged with assaulting his ex-wife at her Florida home.

The Charleston Gazette-Mail reports the charge against Stephen McDaniel was revoked Tuesday after a motion was filed to remove the “erroneously filed” information. McDaniel’s attorney, Terry Shoemaker, says a Florida prosecutor filed the charge last week, despite working with Shoemaker to find a different resolution between McDaniel and his ex-wife.

An arrest report says McDaniel arrived at his ex-wife’s home April 6 after drinking all day. It says the two argued and he pinned her down, covering her face in a way that prevented her from breathing. He told deputies he was trying to quiet her.



The revocation also ends the deferred prosecution agreement McDaniel entered over the charge.
