ST. ALBANS, Vt. (AP) - A judge has denied a request by school districts for a temporary injunction on forced mergers in Vermont under Act 46.
More than 30 districts have joined a lawsuit claiming Act 46 is unconstitutional. They said forcing the districts to merge while the lawsuit was pending would cause “irreparable harm” to the districts and to students.
Vermont Public Radio reports Judge Robert Mello ruled Monday that the districts failed to meet the threshold to qualify for a temporary injunction.
Attorney General TJ Donovan, who is representing the state of Vermont, says the judge’s ruling means the districts are unlikely to succeed in their claims.
Many districts had postponed votes on school budgets pending the judge’s ruling.
Donovan says the ruling provides clarity for districts as they plan for the mergers.
