PHOENIX (AP) - A federal judge says former Arizona Attorney General Tom Horne and a former aide can continue with a wrongful prosecution lawsuit they filed against Yavapai County Attorney Sheila Polk.
U.S. District Judge Steven Logan on Friday declined Polk’s request to toss Horne’s lawsuit.
Horne spent years battling allegations that he illegally coordinated campaign matters with former aide Kathleen Winn when she ran an outside group supporting his 2010 election.
Polk determined he violated campaign finance laws, ordering him to repay $400,000 and face up to $1.2 million in fines. But the Arizona Supreme Court ruled that Polk wasn’t a neutral arbiter, and the Cochise County Attorney later cleared Horne.
Friday’s ruling says Polk should have known that her actions violated Horne’s and Winn’s due process rights.
Polk could not be reached after hours Friday.
