CHARLESTON, W.Va. (AP) - West Virginia Supreme Court justices who ruled in favor of the chief justice’s challenge of her impeachment now say they won’t recall that ruling as the state Senate asked.

A panel of acting justices ruled Oct. 11 that the Senate lacked jurisdiction to pursue Justice Margaret Workman’s impeachment trial. The decision was also applied to retired Justice Robin Davis and Justice Allen Loughry, who resigned after being convicted of federal fraud charges.

The Charleston Gazette-Mail reports the acting panel ruled Monday that the court doesn’t have authority to recall its ruling and there were no extraordinary circumstances to warrant doing so.



The newspaper also reports that Davis on Wednesday dismissed her lawsuit filed two months ago against Gov. Jim Justice and state lawmakers. Davis had contended that Justice and lawmakers impeached her to try to create a conservative, male-majority state Supreme Court.
