COEUR D’ALENE, Idaho (AP) - An Idaho man accused of kidnapping and killing a man in a forest last year has refused to enter pleas to the charges, so a judge entered a not guilty plea on his behalf.
Justin Booth, a convicted felon who was out on parole when William “Bo” Kirk was killed in October 2016, had the plea entered for him Monday at his arraignment, the Coeur d’Alene Press reported (https://bit.ly/2q7IJLk ).
The other defendant in the case, David Hutto, also refused to enter a plea at his arraignment last year and was convicted last month.
Booth has also been charged with robbery, arson and being a felon in possession of a firearm.
The men are accused of stealing Kirk’s pickup truck, tying him up with zip ties and then driving him to a forest to kill him, prosecutors said.
They are also accused of using his credit card. Surveillance cameras from the night show two men in Kirk’s pickup withdrawing cash from his account at multiple banks.
Booth faces a life sentence for murder and robbery if convicted. He faces a 25-year prison sentence for the kidnapping charge and five years for the firearm charge.
