MIDDLETON, Mass. (AP) - A judge has upheld an arbitrator’s ruling to reinstate a Middleton police officer who had a domestic abuse charge against him dropped as part of a plea deal.

The Salem News (https://bit.ly/2msAPWP ) reports that the judge last month upheld the ruling to rehire Brian Kelley.

Kelley was arrested in 2013 on charges of domestic assault and obstructing the report of a crime. He pleaded guilty to disorderly conduct.



Police said Kelley tried to pry his 6-year-old daughter away from her mother, his former girlfriend, when the woman indicated she was leaving and told him to report her for kidnapping.

Police say he grabbed her cellphone.

The town challenged the arbitrator’s ruling, saying Kelley had lost its gun license and it was “ludicrous” to hire an officer without a weapons license.
