LOS ANGELES (AP) - Prosecutors say a Los Angeles County sheriff’s deputy acted lawfully when he shot and killed a man he believed was involved in a road-rage incident last year.

The Los Angeles district attorney’s office released a report Thursday in the January 2016 death of Miguel Hernandez.

Prosecutors say the 39-year-old’s car matched a description of a vehicle wanted for a road-rage incident when Deputy Nathan Gillespie tried to stop him on Jan. 14, 2016.



They say Hernandez got out of the car and refused to show one of his hands.

Prosecutors say Gillespie thought Hernandez retrieved a gun from his waistband and was “about to shoot him.” Gillespie shot Hernandez once in the shoulder.

Investigators say a knife was found under Hernandez’s body.

Prosecutors say Gillespie’s actions were “reasonable under the circumstances.”
