LYNN, Mass. (AP) - Attorneys representing the city of Lynn have requested that a federal judge dismiss a lawsuit filed by a man who served 21 years behind bars for a murder he says he didn’t commit.

The Daily Item (https://bit.ly/2cX3ouK ) reports that 50-year-old Angel Echavarria filed the civil rights lawsuit in June, alleging that Massachusetts State Police and local officers framed him for the 1994 shooting of 37-year-old Daniel Rodriguez.

City attorneys argue that the suit should be tossed because the statute of limitation has expired and Echavarria was granted a new trial due to a shoddy defense - not police misconduct and suppression of evidence.



A Superior Court judge overturned Echavarria’s conviction last year and the state later dropped all charges. No physical evidence ever connected Echavarria to the killing.
