PROVIDENCE, R.I. (AP) - The Rhode Island Supreme Court has declined to hear an appeal from an embattled Providence city councilman who’s trying to block a recall election.

Councilman Kevin Jackson sued to try to block a group of constituents who are seeking his ouster through a recall election.

WPRI-TV reports (https://bit.ly/2iJsKeb) the state Supreme Court on Tuesday declined to hear an appeal that Jackson’s lawyers filed after a Superior Court judge rejected the councilman’s request for a temporary restraining order. The order would’ve stopped the group from collecting signatures for the recall.

The Superior Court cited a lack of subject matter jurisdiction to hear the case.

The longtime Ward 3 Democrat was indicted in July on charges he embezzled more than $125,000 from the Providence Cobras youth track-and-field team.

He pleaded not guilty.
