NEW YORK (AP) - New York City prosecutors have declined to bring charges against a court officer who fatally shot a man trying to rob him at gunpoint outside a Dunkin’ Donuts earlier this year.
Queens District Attorney Richard Brown says 50-year-old Ian Caine was justified in his use of deadly force in the September shooting death of 24-year-old Kadeem Trotter.
Caine was off-duty and heading to his parked car on Sept. 17 when Trotter approached him, pulled out a gun and demanded cash.
Police say the men struggled and Caine ultimately shot Trotter in the chest. Trotter was rushed to Jamaica Hospital, where he died.
Investigators later determined that Trotter’s weapon was a pellet gun.
Trotter’s family has disputed the police account of the incident and filed a $10 million notice of claim with the state.
