BERKELEY, Calif. (AP) — A judge has removed the words “high-calorie” and “sugary drinks” from a soda tax measure set to go before voters in Berkeley in November.

Alameda County Superior Court Judge Evelio Grillo said in an order published on Tuesday that the words were partial and misleading. The Contra Costa Times reports (https://bit.ly/1BbxflI) that he replaced them with the term, “sugar-sweetened beverages.”

Grillo also replaced a reference to “high-calorie, low-nutrition products” in the city attorney’s analysis of the ballot measure.



Berkeley would impose a 1-cent-per-ounce tax on the distribution of sodas and other sugar-sweetened drinks. San Francisco is also set to vote on a soda tax in November. San Francisco’s measure calls for a 2-cent-per-ounce tax.
