UNIONTOWN, Pa. (AP) - A southwestern Pennsylvania judge has rejected a motion to dismiss an involuntary manslaughter charge against a man in the accidental shooting death of a woman last summer.
Twenty-four-year-old Jeremy Hamborsky of Connellsville is charged in Fayette County in the August shooting death of 23-year-old Kylie Sage. Authorities say he was handling a handgun she had just purchased as the two sat in Sage’s pickup truck when it went off.
Defense attorney Emily Smarto argued last month that the commonwealth would be unable to prove that her client’s actions were negligent or reckless. Prosecutors contend that Hamborsky had been drinking and failed to confirm that the gun was unloaded.
