CLARKSBURG, W.Va. (AP) - Federal prosecutors say the 2007 killing of an inmate at the U.S. Penitentiary at Hazelton wasn’t self-defense.
In a court motion, prosecutors say 33-year-old Kevin Bellinger shouldn’t be allowed to claim self-defense or defense of others.
Bellinger and co-defendant Patrick Franklin Andrews are each charged with aiding and abetting murder. The charge stems from the slaying of another inmate, 28-year-old Jesse Harris.
Assistant U.S. Attorney Brandon Flower says in the motion that prosecutors anticipate Bellinger will raise the issue of self-defense or defense of others.
The motion says surveillance video showed that Harris was unarmed and tried to escape the attack. He suffered stab wounds to the head, back, neck, arm, lung and heart.
