BATTLE CREEK, Mich. (AP) - A Battle Creek police officer will not be charged with a crime for taking a suspect to the ground.
According to the Battle Creek Enquirer (https://bcene.ws/1p6iz0J ), Calhoun County Prosecutor David Gilbert said Monday he does not plan to charge the officer in the 2012 incident in a convenience store parking lot.
Interim Chief Jim Blocker asked for a review by the state police after city officials raised questions about the incident involving Kenneth Moye, a suspect in a domestic violence complaint.
Battle Creek officials paid Moye $31,000 in exchange for him agreeing not to sue the city.
Battle Creek police officials previously found that the officer did not use excessive force.
Gilbert says he reviewed the state police report along with surveillance camera footage before reaching his decision.
