PUEBLO, Colo. (AP) - A Pueblo judge has denied a request by a man convicted of murder to have his 42-year prison sentence reduced by a decade.
The Pueblo Chieftain reported Sunday (https://bit.ly/1ficsPY ) that District Judge William Alexander denied 22-year-old Devin Downey’s request, noting that the man avoided a potential life sentence with his plea.
Downey was sentenced in February 2013 for the Feb. 12, 2011, death of 45-year-old Pedro Solis-Astorga. Downey struck a deal with prosecutors and pleaded guilty to second-degree murder.
Police say he was smoking marijuana in a Pueblo park when Solis-Astorga approached him. Investigators also suggested Downey shot the man because he wanted to avoid the disclosure of his sexual activities in the park.
