OPELIKA, Ala. (AP) - A jury in Opelika will deliberate a second day on what sentence to recommend for an Auburn man convicted of capital murder in a community college shooting.
The jury deliberated nearly two hours Wednesday in the case of 37-year-old Thomas Franklin May III and then recessed until Thursday morning. The jury can recommend either death or life in prison without parole. The final decision is up to Circuit Judge Jacob Walker.
The jury took 90 minutes Tuesday to convict May of capital murder and attempted murder for killing his mother-in-law and wounding his estranged wife at Southern Union State Community College in June 2011.
Prosecutors say the death penalty is appropriate because May ignored a court order to stay away from his wife. Defense attorneys are seeking life without parole.
