MISSOULA, Mont. (AP) - The city of Missoula is appealing a District Court ruling that it must pay just over $180,000 in legal fees in a case in which the city was found to have illegally taken private land to widen a road.

A group of 17 property owners along South Avenue sued the city in 2005. Six years later, District Judge Ed McLean found the city should have used eminent domain proceedings before taking the land. He awarded just over $157,000 to the property owners and nearly $73,000 in fees and costs.

The city appealed and the Supreme Court upheld McLean’s ruling. Earlier this month, a District Court found the city owed the plaintiffs a total of $180,000 in attorney fees and costs.



City chief administrative officer Bruce Bender tells the Missoulian (https://bit.ly/OohpRs) the city is appealing the additional attorney’s fees.
