PHOENIX (AP) - A medical examiner’s report says an intoxicated man subdued by Phoenix police with a choke hold and a stun gun died because of lack of oxygen to his brain.
But the Maricopa County Medical Examiner’s report is unclear what killed 44-year-old Miguel Ruiz last summer - the choke hold or methamphetamine in his system.
The Arizona Republic (https://bit.ly/1nfgtvL) says Ruiz’s family has filed a $30 million notice of claim against Phoenix. That’s a precursor to a lawsuit.
Police say Ruiz climbed onto the roof of his Phoenix apartment complex for unknown reasons July 28.
He later jumped onto a stairway one story below and was subdued by police officers.
An attorney for Ruiz’s family says he was brain dead upon arrival at a hospital.
Police decline comment, citing possible litigation.
