BILLINGS, Mont. (AP) - A Hardin man who was expected to plead guilty to second-degree murder in the November stabbing death of a St. Xavier man now says he wants to face trial.
Federal prosecutors told The Billings Gazette (https://bit.ly/Kh5tOH ) on Monday that 40-year-old John Harold Holds III was scheduled to plead guilty on Tuesday. But during a hearing before U.S. Magistrate Carolyn Ostby, Holds’ attorney said Holds had decided to stand trial in the death of 42-year-old Franklin Red Wolf on the Crow Reservation.
Documents filed Monday said a woman told investigators that Holds walked into her house at about 3 a.m. on Nov. 2 and told her “a guy made advances toward him and he cut him in the neck.” She said he was carrying two bloody knives.
Trial is now set for Jan. 21.
